Just because you were hurt in a Texas accident, doesn't necessarily mean that you will recover money from the negligent person. It also doesn't mean you have a personal injury case.


There are basically three things that make a good Austin personal injury case. Number one, there needs to be fairly serious injuries. A minor fender bender that doesn't result in major injuries probably won't require the assistance of a lawyer and can most likely be resolved with the insurance company.


The second aspect of a good case involves clear liability. It won't do you any good to sue someone if it appears the accident was your fault. In Texas, if you were more than 50 percent at fault for the accident, you won't recover a dime.


Lastly, there needs to be a way to recover money from the other side, which usually involves an insurance policy. If there is no way to recover damages, it is generally not worth your time to pursue a personal injury lawsuit.
