Texas does not have a statewide ban on cell phone use. However, the Texas Department of Transportation (TxDOT) does encourage drivers to pull over if they need to make a phone call, send a text message or check their email. The following are the current cell phone restrictions in Texas:

  • Drivers under age 18 may not use a wireless communication device while driving. This ban applies to both handheld and hands-free communication devices.
  • Novice drivers, those with a learner’s permit, may not use a handheld wireless communication device for the first six months of driving.
  • Drivers may not use a handheld wireless communication device when driving in a school zone. Hands-free communication devices are permitted.
  • School bus drivers may not use a handheld wireless communication device while driving if any children are on the bus.
  • More than 20 Texas cities, including Austin and San Antonio, have local ordinances that prohibit or limit cell phone use and texting.

According to the Texas Department of Transportation, almost one out of every four crashes involves a distracted driver. Drivers who use a cell phone while driving have a greater chance of getting into a car accident than those who do not use a cell phone. The risk is the same even with a hands-free device.
