Collaborative Law



For those that want to get their divorce resolved by having both parties and their attorneys work together in an agreeable way, one of the best approaches is Collaborative Law.  Collaborative law is a terrific and less expensive way for people to work together and solve their problems.  Most cases never go to trial, so ultimately most parties need a strong and effective negotiator who is comfortable in mediation as well as informal direct negotiations.

An experienced lawyer will help advise you to choose your battles wisely.

In any case, our goal is to resolve the issues as efficiently as possible, without going to court if that is possible.  We always consider mediation before going to trial. Settling in mediation is less costly, and the emotional toll on families is always less severe, than going to court. If you must have an ongoing relationship with the other party after the divorce, the more you can preserve your relationship through the divorce process, the better off you will be at the end.


Collaborative law is another option for resolving your case.  The parties agree to share all information between themselves, the attorneys and any hired experts in order to resolve the case without the need to go to court.  The catch is, if you cannot agree on something and have to have a hearing in court, the collaborative attorneys must withdraw and the parties must hire different attorneys to proceed with the case.  While this can be a hassle, it motivates the parties to try and resolve the case without the need to involve the court.

Avoiding an adversarial relationship is especially important when children are involved. Developing a respectful discourse can pave the way to a peaceful co-parenting situation and will prepare both of you to communicate productively on issues like custody and parenting plans.
